The property for sale is Viewpoint Peñon of Guacalillo, properly speaking of its geographical location, it is located on Costa Rica’s Pacific coast, between Playa Bajamar and Playa Azul, the small town of Guacalillo, Costa Rica is a relatively little known beach on the western side of the country, except for the nationally and internationally recognized and visited Viewpoint Peñón de Guacalillo, rated and recommended by TripAdvisor, as well as by a countless number of tourism websites that praise its natural and scenic beauty. Along its extension of approximately 2 hectares there are impressive and steep cliffs with volcanic rocks of different colors and unique rock formations that compose an incredible natural scenic attraction, together with a bay that delights with magnificent views of the ocean, attracting many visitors during all seasons of the year. There are some other extensions of land of different sizes, near and next to the Peñón that could eventually be included in the negotiation process for its sale, given that the sale will be made by segregation of the mother property through public deed and subsequent drawing up of the cadastral plan for its corresponding inscription.
As a brief review of the background of the property to be sold, Viewpoint Peñon de Guacalillo is located within the property with real folio 6-045251 and with the cadastral map P-0492695-1982, registered in the National Registry of Costa Rica, property that includes the strip of land known as maritime mile for having as origin a property title granted by the Spanish Crown to Juan Vásquez de Coronado on May 29, 1564, such title gives origin to the diligences of remedy carried out on May 18, 1709, diligences that extended the domain or property right to the sea, few properties in Costa Rica, at present, possess this invaluable characteristic. Another relevant fact that ratifies the ownership of the maritime mile is that the property has a deed of sale granted at 3 o’clock in the afternoon of February 17, 1850, deed that gives origin to the process of possessory information that was registered in the National Registry on October 15, 1919, the acting company obtained the right of ownership by positive prescription. It was clarified that the first sentence related to such process was issued by a Civil Judge of the Treasury at 4:00 p.m. on June 30, 1961, which in turn was presented before the same National Registry at 2:42 p.m. on March 25, 1963, acknowledged under the citations entry 5993 and volume 257 of the journal, in San José, on May 2, 1963. At the present time the property belongs to the Bajamar Community Association, whose legal representation as proxy is held by Mr. Fernando Tristán Soubrie, as its name indicates the commercial activity that is exploited is that of viewpoint, as a touristic facility, on the site, photo shoots are conducted for various brands across the country, corporate events have been held, concerts, bicycle races and a large number of private events of the most varied nature. Given its truly unique characteristics, not only in terms of the right of ownership of the mile as the unbeatable advantage that, since there is no regulatory plan in the area by the municipality, practically any type of residential, commercial and industrial activity can be developed or carried out, or even of mixed character.
